Welcome to HomestagingKI. These terms govern the use of our website and services. By using HomestagingKI, you agree to these terms.

1. Scope

These terms apply to all agreements regarding the use of the HomestagingKI platform and services.

2. Service

HomestagingKI provides a web-based platform for AI-powered visualization and virtual staging of real estate (virtual staging).

3. Registration

Registration is required to use our services. You must provide complete and accurate information.

4. Pricing and payment

We offer different subscription plans. As a small business under Section 19 of the German VAT Act (UStG), no VAT is charged or shown.

5. Usage rights and copyright

You retain all rights to images you upload. You receive full usage rights to images generated by our AI.

6. Liability

We are liable without limitation for intent and gross negligence. The quality of generated images depends on multiple factors.

7. Cancellation

You can cancel your subscription at any time effective at the end of the current billing period.

8. AI labeling

All generated images contain machine-readable markings identifying them as AI-generated (Art. 50(2) EU AI Act). Deliberately removing or suppressing these markings is prohibited. When publishing AI-edited images of real rooms, the customer additionally has their own disclosure obligation (Art. 50(4) EU AI Act).

9. Business directory and unclaimed profiles

In addition, the platform operates a business directory for real estate agents and home staging providers. It also contains profiles of businesses that have not created a user account (unclaimed profiles). These are based on publicly accessible sources, in particular open directory and map service data as well as the business's own website. The legal basis for this processing is our legitimate interest in a comprehensive business directory (Art. 6(1)(f) GDPR). This information does not constitute a warranty of any characteristics of the business.

10. Images in the directory

We do not copy images from third-party websites or map services into the directory. Newly added images on profile pages come from the respective businesses themselves (own uploads) or are our own or AI-generated illustrations. Images taken over from publicly accessible sources in the past are being removed step by step and are deleted without delay upon notice. Please send notices to info@homestagingki.com.

11. Reviews in the directory

Reviews displayed on profile pages may be aggregated from publicly accessible sources or created editorially – including by automated means. We do not verify whether reviews actually originate from consumers who have used the business's services; they are not verified customer reviews. Businesses can dispute reviews at any time; disputed reviews are examined and inadmissible ones are removed without delay.

12. Correction and deletion of entries

Businesses can request the correction or complete deletion of their entry at any time (by email to info@homestagingki.com or via the platform's contact feature). Requests are usually implemented within 5 business days; on request, the entry is permanently blocked from being re-created automatically.
